REAL DIAPER ASSOCIATION 100% REUSABLE CLOTH DIAPERS PHOTO CONTEST

OFFICIAL RULES

Eligibility US Residents Only: The Second Annual Real Diaper Association Photo Contest (the “Contest”) is open only to legal residents of the fifty United States (including D.C.), who are at least 18 years of age or older at time of entry.  Employees, officers and directors of Real Diaper Association (“RDA”) and of sponsors, as well as their immediate family members and those living in the same household of each, are not eligible to participate in this Contest. Subject to all applicable federal, state, provincial, and local laws and regulations. 

Contest Period 10/19 - 11/3: The Upload Phase of the Contest runs between 12:00 AM Pacific Time (“PT”) on October 19, 2010 and 11:59 PM PT on November 3, 2010. The Winner Voting Phase of the Contest runs between 12:00 AM PT on November 5, 2010 and 11:59 PM PT on November 6, 2010.  RDA’s computer is the official time keeping device for the Contest.

How to Enter: Complete the entry form on the RDA website. Follow the directions to upload and submit a photograph of your baby in a 100% reusable cloth diaper. The diaper must be clearly visible in the photograph.  All photographs must be of babies who are between 0-48 months of age at the time the photograph was taken. NOTE: You must be the parent or legal guardian of the baby featured in the photograph. Each photograph must have been taken by the person submitting it for entry into the contest.

Photo Guidelines: Submitted photos must be horizontal (landscape) orientation, at least 300 dpi, 2300 x 1800 pixels.  The subject should be less than 7 ½” tall and within 7 ½” wide to best fit the calendar specifications.  Any manipulations of an image must have been done by the photographer. Photographs may be in color, sepia, or black and white.
Hint on how to win: While we have to be able to see the cloth diaper, this contest is not about how clearly the diaper itself is shown or how beautiful it is on its own -- it's about how great the photograph is and how compelling it is to look at. We want 12 really engaging, gorgeous photographs featuring happy babies in cloth diapers.Voters will be instructed to give preference to photos that illustrate the ease and benefits of using 100% reusable cloth diapers in a variety of situations.

NOTE: Your photograph(s) and description(s) will be posted online and viewed by other people.

Limit one entry per participant: Each Contestant may enter only one (1) photograph during the Upload Phase of the Contest. Multiple participants are not permitted to share the same email address. Any attempt by any Contestant to obtain more than the stated number of photo entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Contestant's entries and that Contestant may be disqualified.

Photographer/Copyright
Entries must be submitted by the original photographer. Do not submit a photo taken by someone other than you. You must be the sole owner of the copyright of any image submitted - - which usually means you haven’t already submitted it in another photo contest. Your submission of the photo is your guarantee that you are the author and copyright holder of the photo. In addition, by entering, Contestants represent and warrant that the entries that they submit do not infringe any other person’s or entity’s rights.

Ownership/Use Rights
By entering the Contest, Contestants irrevocably grant to the Real Diaper Association the ownership of  and  right to use the photo in any and all media including, but not limited to, the Real Diaper Association website, their newsletter, blogs, press releases, and other communication channels at their discretion, and in any advertising or promotional media, without additional compensation, and releases the Real Diaper Association and any entity acting on its behalf from  any liability related to use of the photo.  In the event that ownership of any photograph submitted is contested in any manner, RDA may disqualify that photograph and discontinue use of the photograph, in RDA's sole discretion.

Public Viewing/Voting: Subject to these Official Rules, all submitted Entries will be posted to the RDA Contest Webpage for public viewing.  Once the deadline for submission of photos has passed, RDA donors will be allowed to vote for their favorite entry.  Voters must be active RDA donors as of 11:59 PM PT on November 3, 2010.  Each donor may cast only one vote.  The 12 eligible entries receiving the highest number of votes will be the winners.  The eligible entry with the highest number of votes will be the cover photo for the calendar as well as appearing in one of the calendar months.  In the case of a tie between two (2) or more entries, the final decision regarding the winning entry will be made by the RDA Board of Directors in its sole discretion. 

Verification/Disqualification: Contestants whose photographs are chosen as potential winners will be notified on or about November 6, 2010 by phone or email using the contact information given at the time of entry. Each Contestant will be required to sign and return an Affidavit of Eligibility and Liability Release within five (5) days from the date of the notification. If the contestant does not return such documentation within the required timeframe, then he/she will be disqualified and RDA will select another finalist with the next highest score.

PRIZES: Grand prize (sponsored by diapershops.com): The one [1] winner with the highest number of votes will be chosen to be on the cover of the calendar. The grand-prize-winning photographer will receive their choice of either a Flip UltraHD 2nd Generation Video Camera 8 GB, 2 Hours or a $150 gift certificate to Kelly’s Closet.  Runners-up (sponsored by Metro Minis and Suburban Tree Hugger): The winners with the next two (2) highest number of votes will receive either a $50 gift certificate to Metro Minis or a $50 gift certificate to Suburban Tree Hugger (the photographer with the highest number of votes chooses first, then the third-place winner gets the other). The top twelve [12] winning photographs will be selected to fill the pages of the Real Diaper Association 2011 calendar.  Each winner will receive one [1] copy of the Real Diaper Association 2011 calendar.
Total value of all prizes to be awarded is approximately $400. No cash equivalent and all prizes are nontransferable and no substitution will be made except as provided herein at the RDA’s sole discretion. RDA reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

Odds of Winning: The odds of winning the Contest are a function of a number of factors including, but not limited to, the number of entries, number of votes cast, number of votes you cause to be cast for your photo, the date of entry and quality of the photograph.

Privacy Policy: Any information provided to the RDA through participation with the Contest is used by the RDA and participating sponsors to communicate with the Contestant as needed. The contact and personal information of the Contestant is never sold, rented, nor otherwise given away or distributed without consent from the Contestant.

General Conditions: By entering or participating in the Contest, Contestants agree to be bound by these Official Rules. RDA assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any entry or other information, or for the failure to capture any such information. RDA is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or 5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Contestant’s participation in the Contest or receipt or use or misuse of any prize. Further, if, for any reason, the Contest is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of RDA, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, RDA reserves the right, at their sole discretion, to cancel, terminate, modify or suspend the Contest, and select the winners for the Contest, from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by RDA.RDA reserves the right to disqualify any entries that are not in keeping with their mission to promote reusable cloth diapers, and all disqualifications will be at their sole discretion.

Contestants, by participating in this Contest, hereby waive and release, and agree to hold harmless RDA and Contest Sponsors, and their respective parents, subsidiaries, affiliates, distributors, advertising and promotions agencies and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Contest, or their participation in the Contest.

The Contest, prizes and winning of such prizes are void where prohibited by law. The Contestant assumes the total responsibility of knowing if they are subject to any local, state or national laws. RDA accepts no responsibility for making these individual legal determinations.  Any dispute regarding these rules or the results of this contest shall be governed by California law and the venue for any proceeding arising hereunder shall be the appropriate court in San Diego County, California.
